1. Introduction
Welcome to academicfellows.co.uk. These Terms and Conditions (“Terms”) govern your access to and use of the Platform and the Services available through it. By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms.
The Platform provides educational support, tutoring, mentoring, consultation, guidance, feedback, and related learning Services designed to support independent learning and skill development. Nothing provided through the Platform is intended to replace your own judgement, effort, or responsibility.
Throughout these Terms, “Platform” refers to the website, “Services” means all educational support and related services available through the Platform, “we”, “our”, and “us” refer to the Platform operators, and “you”, “your”, “user”, and “client” refer to any individual using the Platform or Services.
2. Educational Support Services
The Platform connects Users with independent Tutors who provide educational support, mentoring, consultation, subject guidance, feedback, editing support, research guidance, study planning, and other learning-related Services.
All Services are provided solely for educational purposes and are intended to enhance understanding, develop knowledge, strengthen skills, and encourage independent learning. Neither the Platform nor any Tutor undertakes educational work on behalf of Users.
3. Using the Services
Users may request Services by providing the relevant request details and any additional information reasonably required to assess and deliver the requested support.
A binding agreement is formed only after we confirm acceptance of the request. Confirmation may be provided by email, online messaging, or another communication method used by the Platform.
Where applicable, full payment must be received and verified before the Services begin. Any estimated timeframe will commence only after payment has been confirmed and all information reasonably required to provide the Services has been received.
Users are responsible for ensuring that any data submitted through the Platform have been obtained lawfully and that they hold all necessary rights or permissions to share them with us and the relevant Tutor.
We and our Tutors will provide the Services with reasonable care and skill in accordance with the Consumer Rights Act 2015.
4. Payments and Pricing
We are committed to transparent pricing. All fees displayed on the Platform are quoted and processed in Pounds Sterling (GBP).
The total amount payable will be clearly presented before payment is made. Prices may vary depending on factors such as the complexity of the request, subject area, level of support required, Tutor expertise, requested timeframe, and other relevant service requirements.
Payments may be made using debit cards, credit cards, Apple Pay, Google Pay, or any other payment methods made available through the Platform. Payment providers may apply their own processing or transaction fees, for which they remain responsible.
The total price may include fees relating to Tutor compensation, Platform operation, payment processing, customer support, administration, and technical infrastructure. We reserve the right to decline or cancel a transaction where we reasonably suspect fraud, unauthorised activity, payment irregularities, or other security or legal concerns.
5. User Eligibility
Access to the Platform is available only to individuals aged eighteen (18) years or over who have the legal capacity to enter into binding agreements.
By using the Platform or purchasing Services, you confirm that the information you provide is accurate, complete, and up to date, that your use of the Platform complies with applicable laws and regulations, and that you will not use the Platform for any unlawful or prohibited purpose.
We may refuse, suspend, or restrict access where we reasonably believe that these Terms have been breached, false information has been provided, or the Platform has otherwise been misused.
6. User Responsibilities
You agree to give accurate information and sufficient request details to enable the Services to be provided effectively. You are responsible for complying with applicable laws, institutional rules, and relevant policies when using the Platform.
You remain solely responsible for your own decisions, educational work, assessments, submissions, research activities, and compliance with any institutional or professional requirements. Any guidance, consultation, feedback, or other educational support provided through the Services should be used responsibly and with your own independent judgement.
7. Refund Policy
Refund requests must be submitted in writing to our support team within 14 days after the Services have been provided. Each request will be assessed individually, taking into account the circumstances of the request, the extent of the Services already delivered, communications between the parties, and any applicable consumer protection legislation.
Refunds may be considered where duplicate payments have been made, an incorrect charge has resulted from a technical or processing error, the Services cannot reasonably be provided, or exceptional circumstances justify a refund. Refunds may be declined where the Services have already been substantially delivered, where the request is based solely on dissatisfaction with a particular outcome, where inaccurate or incomplete information was supplied by the User, or where these Terms have been breached.
Users should contact our support team before initiating a chargeback or payment dispute. Nothing in this section affects any statutory rights available under applicable UK consumer protection legislation.
8. Intellectual Property Rights
All intellectual property rights in the Platform, including its branding, trade marks, logos, text, graphics, software, educational materials, databases, and other content, are owned by us or our licensors and are protected by applicable intellectual property laws.
Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, and revocable licence to access and use the Platform for lawful personal and educational purposes only. You must not copy, reproduce, distribute, modify, publish, sell, commercially exploit, or otherwise use any part of the Platform without our prior written permission.
9. Educational Integrity and Responsible Use
The Platform exists to promote learning, independent thinking, and responsible educational development. The Services are intended to provide explanations, guidance, consultation, mentoring, coaching, and feedback that help Users strengthen their own understanding and skills.
You remain solely responsible for ensuring that your use of the Services complies with the rules, regulations, policies, and integrity requirements of your educational institution or professional body, as well as all applicable laws. Neither the Platform nor any Tutor accepts responsibility for the way in which guidance or information obtained through the Services is subsequently used.
10. Disclaimer of Warranties
The Services are provided on an “as available” basis. While we use reasonable care and skill in providing the Services, we do not guarantee that the Platform will always be uninterrupted, error-free, or available at all times.
We do not guarantee any specific educational, professional, or personal outcome. Information provided through the Services is intended solely for educational purposes and should not be regarded as legal, financial, medical, or other professional advice.
11. Limitation of Liability
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the laws of England and Wales, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
Subject to the above, we shall not be liable for any indirect, consequential, incidental, or special loss arising from the use of, or inability to use, the Platform or Services, including loss of profits, revenue, data, business opportunities, goodwill, or reputation.
Our total liability in connection with any claim relating to the Services shall not exceed the amount paid by you for the specific Services giving rise to that claim.
12. Indemnity
You agree to indemnify and hold harmless the Platform, its officers, employees, affiliates, licensors, contractors, and Tutors from any claims, liabilities, losses, damages, costs, or expenses arising from your breach of these Terms, misuse of the Platform or Services, infringement of third-party rights, or violation of any applicable law.
13. Data Protection and Third-Party Services
We process personal information in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and other applicable UK data protection legislation. Further information about how we collect, use, store, and protect personal information is available in our Privacy Policy and Cookies Policy.
The Platform may contain links to, or integrate with, third-party websites, payment providers, communication platforms, or other external services for your convenience. We do not control and are not responsible for the availability, content, security, or privacy practices of such third parties. Your use of third-party services is governed by their own terms and conditions and privacy policies.
14. Suspension, Termination, and Force Majeure
We may suspend, restrict, or terminate your access to the Platform or Services if you breach these Terms, fail to meet your payment obligations, provide false or misleading information, engage in unlawful or abusive conduct, or where your continued use may present a legal, operational, security, or reputational risk.
We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control. These circumstances may include natural disasters, severe weather, power or internet outages, cyber incidents, industrial disputes, governmental actions, public health emergencies, or failures affecting third-party service providers.
Any suspension or termination of access shall not affect rights, obligations, or liabilities that accrued before the effective date of termination.
15. Changes to These Terms
We may amend these Terms from time to time to reflect changes in our Services, business operations, or applicable legal requirements. Any updated version will be published on the Platform together with the revised effective date. By continuing to use the Platform after revised Terms become effective, you agree to be bound by the updated version.
16. Governing Law, Consumer Rights, and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
If a dispute arises in connection with these Terms or the Services, both parties agree to make reasonable efforts to resolve the matter through good-faith discussions before commencing legal proceedings. Where a resolution cannot be reached, the dispute shall be submitted to the courts of England and Wales, subject to any mandatory rights available under applicable law.
Nothing in these Terms limits or excludes any statutory rights available under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other applicable UK consumer protection legislation.
17. General Provisions
If any provision of these Terms is held to be unlawful, invalid, or unenforceable by a court or competent authority, that provision shall be deemed severed to the extent necessary, while the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and us regarding your access to and use of the Platform and Services, superseding any previous understandings relating to the same subject matter.
